Electronic Chip Insertion: Nigerian Ask Court To Compel FG To Tackle U.S.

A Nigerian, Jacob Olukunle Ajomale, who was allegedly maltreated by the United States’ Immigration and Customs Enforcement (ICE) officers, by forcefully inserting a tracking device (chip) in his body through his anus, has asked a Federal High Court in Lagos to compel the Nigerian government to drag the United States before the United Nations and other international communities. Ajomale, in a fresh suit before the court, through his lawyer, Femi Falana (SAN), is seeking an order compelling the Nigerian government to further his cause before the international community against the United States with a view to looking into the allegation of inhuman treatment he suffered in the hands of ICE officers since 2010. Ajomale had earlier sued United Airlines and the Nigerian Ministry of Internal Affairs demanding $100 million and N100 million damages for the violation of his fundamental rights to dignity of human person and right to mental and physical health as guaranteed by Sections 35 and 41 of the Constitution and Articles 6 and 12 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act. But the suit was withdrawn while a fresh one was filed before Justice Mohammed Idris against United Airlines, Federal Ministry of Internal Affairs and the Federal Government of Nigeria. When the fresh suit came up before Justice Idris, the judge noted that considering the nature of the suit, being the one that bothered on alleged violation of human rights, there was need for the matter to be urgently heard. The judge then ordered that the defendants be served with the processes in the suit and fixed Friday, August 7, 2015 for hearing.
